Important: By using MyFax.Space, you agree to these Terms of Service. If you do not agree with any part of these terms, you may not use our service.

1. Acceptance of Terms

By accessing and using MyFax.Space ("Service", "we", "us", or "our"), you accept and agree to be bound by the terms and provisions of this agreement. These Terms of Service ("Terms") apply to all users of the Service.

2. Description of Service

MyFax.Space is an online fax service that allows users to send fax documents electronically to fax numbers worldwide. We offer two service tiers:

2.1 Free Tier

  • Up to 3 pages per fax
  • US and Canada destinations only (+1 country code)
  • Maximum 5 faxes per day per email address
  • Includes branded cover page
  • Documents deleted after 48 hours

2.2 Premium Tier

  • $3.29 USD per fax (flat rate)
  • Up to 25 pages per fax
  • Worldwide destinations (international faxing included)
  • No daily limit
  • No branded cover page
  • Documents deleted after 48 hours

3. User Obligations and Responsibilities

3.1 Accuracy of Information

You are responsible for ensuring that:

  • All recipient fax numbers are accurate and correctly formatted
  • You have the right to send documents to the specified recipients
  • Your contact information (name, email) is accurate

3.2 Content Restrictions

You agree NOT to use our Service to send:

  • Unsolicited commercial faxes (spam or junk faxes)
  • Illegal, harmful, or offensive content
  • Content that infringes on intellectual property rights
  • Confidential information without proper authorization
  • Malware, viruses, or harmful code
  • Content that violates any applicable laws or regulations

3.3 Compliance with Laws

  • Telephone Consumer Protection Act (TCPA) in the United States
  • CAN-SPAM Act
  • GDPR and data protection regulations
  • Local telecommunications regulations

4. Payment Terms (Premium Tier)

4.1 Pricing

Premium tier pricing is $3.29 USD per fax transmission, regardless of destination or page count (up to 25 pages). Prices are subject to change with 30 days notice.

4.2 Payment Processing

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for the premium tier service.

4.3 No Refunds Policy

All sales are final. We do not offer refunds for:

  • Successfully transmitted faxes
  • Faxes that fail due to recipient number issues (busy, disconnected, no answer)
  • User errors (wrong number, incorrect document)

Refunds may be considered in the following circumstances:

  • Service outage or technical failure on our end
  • Duplicate charges due to system error
  • Failure to attempt delivery due to our technical issues

5. Service Limitations and Availability

5.1 File Requirements

  • Maximum file size: 10MB total per fax
  • Supported formats: PDF, DOC, DOCX, PNG, JPG
  • Files must be readable and properly formatted

5.2 Delivery Attempts

We will attempt to deliver your fax up to 3 times with exponential backoff (5 minutes, 15 minutes, 30 minutes). If all attempts fail, the fax will be marked as permanently failed.

5.3 Service Availability

  • Perform scheduled maintenance with advance notice
  • Temporarily suspend service for urgent repairs
  • Modify or discontinue features with reasonable notice

6. Data Retention and Privacy

6.1 Document Storage

All uploaded documents and fax content are automatically deleted 48 hours after creation. This is a security measure to protect your privacy.

6.2 Metadata Retention

We retain fax metadata (sender/recipient information, timestamps, delivery status) for 90 days for service quality and support purposes.

6.3 Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Intellectual Property

The Service, including its design, functionality, and content (excluding user-submitted documents), is owned by MyFax.Space and protected by copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

Important Limitation: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims related to the Service is limited to the amount you paid for the specific fax transmission in question (maximum $3.29 USD).

  • Failed deliveries due to recipient issues (busy line, disconnected number, etc.)
  • Loss or corruption of fax content during transmission
  • Delays in delivery
  • Third-party service provider failures (including Stripe, Sinch, email providers)
  • Damages resulting from unauthorized access to your account
  • Business losses, lost profits, or lost opportunities

9. Indemnification

You agree to indemnify and hold harmless MyFax.Space, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your use or misuse of the Service
  • Content you submit or transmit through the Service

10. Account Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for:

  • Violation of these Terms
  • Fraudulent or abusive behavior
  • Suspected illegal activity
  • Non-payment of premium tier services

11. Dispute Resolution

11.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at [email protected] to attempt to resolve the issue informally.

11.2 Arbitration

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

11.3 Class Action Waiver

You agree to bring claims against us only in your individual capacity and not as part of any class action or representative proceeding.

12. Modifications to Terms

  • Posting the updated Terms on this page
  • Updating the "Last Updated" date
  • Sending email notification for significant changes

Your continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
